I Samuel Rhodes of said County being of advanced age & in feeble health do make this following Last Will & Testament hereby revoking all other heretofor made.

Item 1st. I will all my just debts paid & all the residue of my property to remain with my beloved wife Esther Rhodes during life & widowhood for her support & maintenance & to be used in such manner as she may desire.

Item 2nd. At the termination of my wife's life or widowhood I wish all the property to be equally divided among my children but the share which would come to my son Joseph to go to his four children by his wife Catharine Rhodes & if either of said four children should die before the age of twenty one years the survivors to take the share so left.

Item 3rd. I appoint my beloved wife Executrix & my son William Rhodes Executor with power to carry out my Will.

In witness whereof I have hereto set my hand and seal this April 23rd, 1862.

Signed sealed declared & published as the last Will & Testament of Samuel Rhodes in presence of us who signed in his presence & in presence of each other at his request.

Personally appeared in open court F. C. Armstrong & Saml. Barnett two of the subscribing witnesses to the written instrument who being duly sworn depose & say that they saw Saml. Rhodes sign & seal the same which he acknowledges as his Last Will & Testament & at the time of his so doing he was of sound disposing mind & memory that they signed the same as witnesses in his presence at his request together with James H. Lane.

Sworn to & subscribed in open Court June 2 1862.

GENEALOGICAL NOTES: Samuel Rhodes (the son of Benjamin Rhodes) is my [Lisa Bridges] 4th-Great-Grandfather. Samuel married Esther Wheatley on April 27, 1820 in Wilkes County. They had seven children: Joseph Wheatley Rhodes (who predeceased his father), John W. Rhodes, Benjamin F. Rhodes, Nancy Rhodes, Simeon Rhodes, Samuel Greenberry Rhodes, and my GGG-Grandfather William Whitfield Rhodes, who was Co-Executor of his father's Will along with his mother Esther.
